This website (Site) and all content and material which are found within this Site (Material) are made available to you by Medspace Technologies Pty Ltd (ACN 615 172 980) (Medspace or us), subject to these terms and conditions (Terms). By continuing your visit of this Site, and accessing Material, you acknowledge your intention to be bound by these Terms, and that a binding and enforceable contract will be created between you and Medspace, as the owner of this Site and Material. For this reason, you should read these Terms carefully before you continue your visit of this Site. If you do not agree to these Terms, you must leave this Site.

In accordance with these Terms, Medspace grants you a non-exclusive, non-assignable, fee free and revocable licence to use: (1) this Site as a mere visitor who has an interest in the services of Medspace, either as a potential service subscriber, or as a work applicant or as an expressed invitee of Medspace (collectively Authorised Users, and if one, Authorised User); and (2) the Material only for self-education or to consider whether you would like to subscribe to the services of Medspace. All other uses of this Site and of Material are prohibited.
If you are an Authorised User, you may print one copy and retain an electronic copy of any page within this Site for your personal and non-commercial use. Subject to the immediately following provision, you must not reproduce such material without the written consent of Medspace.
You may share, recommend or express that you like Material from this Site on third party social media as long as you do so by linking directly to this Site, retain the original source and form of posted Material, and not claim any right to, or interest in such postings.

2. Intellectual property rights
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, Content), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of the preceding, contained in this Site is either owned, controlled or licensed by or to Medspace, and is protected by copyright and trademark laws, and various other intellectual property rights. Your use of this Site and of Materials does not entitle you to any of such rights or interests, other than rights described herein.
You must not reverse engineer, or directly or indirectly allow or cause a third party to reverse engineer the whole or any part of this Site. Except as expressly provided in these Terms, no part of the Site and no Content or Material may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution, or for any commercial enterprise.
You must not impersonate or fraudulently represent Medspace in any way, including through the prohibited use of any Medspace trademark which appears on this Site, regardless of whether such trademark has been expressly stated to be a trademark of Medspace. A trademark can be a word, phrase, symbol, or design which distinguishes Medspace, and its works, products and services. A trademark includes the trade dressing of Content or Material, for example, the appearance, size, shape, colors, textures and graphics of any Content or Material.
Medspace may make changes to any service offered on this Site, or to the applicable price for any of such services at any time, without prior notice. Services and pricing advertised on this Site are mere invitations to treat which Medspace will generally apply when its services are subscribed. However, it may be the case that based on your specific requirements or circumstances, services not within the contemplation of Medspace are required. If so, Medspace reserves the right to offer its services to you in a manner which is different from advertised services and pricing.
Medspace’s obligations, if any, with regard to its services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter or to take precedence over such agreements.
This Site is professionally hosted and operates in a secure environment; however, you should be aware that there remain inherent risks associated with receiving and transmitting information via the internet. Whilst Medspace strives to protect such information, it does not warrant and cannot ensure the security of any information which you receive or transmit through this Site. Accordingly, any information which you receive or transmit through this Site will be received or transmitted at your own risk. Notwithstanding the foregoing, Medspace will use reasonable endeavours to preserve the security of information received and transmitted by you through this Site.
Each Material is provided “as is” and is of general application. Medspace makes no representations or warranties in relation to Materials. You should not rely on any Material before consulting us. You release all claims against us which relate to Materials. Materials may become out of date. Medspace makes no commitment to update Materials when they become out of date.
Medspace does not sponsor, approve, endorse or guarantee any link to third-party websites or content which may be found on this Site, or in any social media platform subscribed by Medspace. Information provided by other parties does not necessarily represent the view of Medspace.
To the full extent permitted by law, Medspace excludes all representations, warranties and terms, whether express or implied, other than those expressly set out in these Terms.
Except where prohibited by law, Medspace will not be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits.
If a provision of these Terms is invalid or is unenforceable, it is to be read down or severed to the extent necessary without affecting the validity or enforceability of remaining provisions.
8. Governing law and jurisdiction
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You agree to submit to the jurisdiction of competent courts in South Australia and the Commonwealth of Australia.
